A. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you, either personally or on behalf of an entity ("you"), and VideoSwapFace ("we," "us," or "our"), governing your access to and use of https://videoswapface.com and any related web pages, applications, tools, media channels, or services linked to these Terms (collectively, the "Site" or "Services").

By accessing or using the Site, uploading media, generating AI outputs, creating an account, or making a purchase, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site or Services.

B. Our Services

VideoSwapFace provides AI-powered tools for face swap, video face swap, GIF face swap, and related image or media generation workflows. The Services may allow you to upload images, GIFs, videos, or other media ("User Content") and receive AI-generated results ("AI Outputs").

We may modify, suspend, or discontinue any part of the Services at any time, including features, pricing, credits, generation limits, model availability, supported file types, or output quality settings.

The Services are provided for creative, entertainment, personal, and lawful commercial use, subject to these Terms and all applicable laws.

C. User Accounts and Access

You may be required to sign in or create an account to access certain features, save history, use credits, or make purchases. You agree to provide accurate, current, and complete account information and to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. If you believe your account has been compromised, contact us promptly at [email protected].

We may suspend, restrict, or terminate access to your account or Services if we believe you have violated these Terms, created risk for other users, attempted fraud or abuse, or used the Services unlawfully.

D. Acceptable Use

You agree to use the Services only for lawful, respectful, and authorized purposes. You must not use the Site or Services to:

  • Upload, generate, distribute, or request content that violates any law or regulation.
  • Create impersonation, deceptive, defamatory, harassing, abusive, hateful, exploitative, or non-consensual content.
  • Use a person's face, likeness, image, voice, identity, or private information without the rights, consent, or legal basis required for your intended use.
  • Create sexual, intimate, explicit, humiliating, or exploitative content involving a real person without their consent, or involving any minor under any circumstance.
  • Infringe intellectual property, privacy, publicity, contractual, or other rights of any third party.
  • Mislead others into believing AI-generated media is authentic when that would be deceptive, harmful, or unlawful.
  • Upload malware, harmful code, corrupted files, or content intended to interfere with the Site.
  • Scrape, reverse engineer, overload, probe, attack, bypass, or attempt unauthorized access to the Site, APIs, infrastructure, models, or security systems.
  • Resell, sublicense, or provide the Services as a competing service without our prior written permission.

You are solely responsible for your User Content, AI Outputs, and how you use, publish, disclose, or distribute them.

E. User Content and AI Outputs

You retain ownership of rights you already hold in your User Content. By uploading User Content, you grant us a limited, worldwide, non-exclusive license to host, process, transform, transmit, display, and store that content as necessary to provide, secure, troubleshoot, and improve the Services.

Subject to your compliance with these Terms and applicable law, we do not claim ownership over AI Outputs generated for you. However, you are responsible for ensuring you have the rights and permissions necessary to use both the User Content and AI Outputs.

Because AI-generated outputs may be similar to outputs generated for other users, you acknowledge that:

  • AI Outputs may not be unique.
  • Similar or identical outputs may be generated for other users.
  • We do not guarantee that AI Outputs are free from third-party rights claims.
  • You should review outputs before using them in public, commercial, professional, or sensitive contexts.

We may remove, restrict, or refuse to process content when we believe it violates these Terms, applicable law, platform safety requirements, or third-party rights.

F. Intellectual Property Rights

The Site, Services, software, user interface, source code, databases, design, text, graphics, logos, trademarks, service marks, and other materials provided by VideoSwapFace are owned by us or licensed to us and are protected by intellectual property and unfair competition laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services for your personal or internal business purposes.

You may not copy, reproduce, modify, distribute, sell, lease, sublicense, publicly display, create derivative works from, or exploit any part of the Site or Services except as expressly allowed by these Terms or with our prior written permission.

G. Payments, Credits, and Refunds

Some features may require payment, subscription, credits, or other paid access. Prices, credit amounts, generation limits, and plan details are displayed at the time of purchase and may change from time to time.

Payments may be processed by third-party payment providers. We do not store your full payment card information. By making a purchase, you authorize the applicable payment provider to charge the payment method you provide.

Because AI generation credits and digital services are delivered immediately or made available shortly after purchase, completed purchases are generally non-refundable unless required by applicable law or expressly stated in a specific offer. We may, at our discretion, review refund requests for duplicate charges, technical failures, or other exceptional circumstances.

Credits, if offered, may be subject to expiration, usage limits, abuse controls, or plan-specific conditions. Credits have no cash value and may not be transferred, resold, or exchanged except as expressly permitted by us.

H. Privacy and Data Protection

Our Privacy Policy explains how we collect, use, share, and protect personal information and uploaded media. By using the Site or Services, you agree that we may process your information as described in our Privacy Policy.

I. Security

We use commercially reasonable technical and organizational measures to protect the Site, Services, and user information. However, no internet-based service is completely secure, and we cannot guarantee absolute security.

You agree not to attempt to bypass, disable, damage, probe, or interfere with any security, access control, rate limit, abuse prevention, payment, or content moderation system.

  • AI Outputs will meet your expectations or be error-free.
  • The Services will always be available, uninterrupted, secure, or free of defects.
  • User Content or AI Outputs will be preserved indefinitely.
  • AI Outputs are suitable for legal, medical, financial, biometric, identity verification, or other high-stakes uses.

You use the Site, Services, User Content, and AI Outputs at your own risk.

L. Limitation of Liability

To the fullest extent permitted by law, VideoSwapFace and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, goodwill, content, business opportunities, or service access.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of (a) the amount you paid to us for the Services in the three months before the event giving rise to the claim, or (b) USD $50.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

M. Indemnification

You agree to defend, indemnify, and hold harmless VideoSwapFace and its owners, employees, contractors, service providers, and affiliates from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use or misuse of the Site or Services.
  • Your User Content or AI Outputs.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your infringement or violation of any third-party rights, including intellectual property, privacy, publicity, or consent rights.

N. Termination

We may suspend or terminate your access to the Site or Services at any time if we believe you have violated these Terms, created legal or security risk, abused the Services, or used the Services in a way that may harm us, users, third parties, or the public.

You may stop using the Services at any time. Termination does not affect provisions that by their nature should survive, including intellectual property, payment obligations, disclaimers, limitation of liability, indemnification, and dispute provisions.

O. Governing Law and Disputes

These Terms will be governed by applicable law without regard to conflict-of-law rules. Before filing any formal claim, you agree to first contact us and attempt to resolve the dispute informally.

Nothing in these Terms prevents either party from seeking urgent injunctive or equitable relief for security incidents, intellectual property misuse, unauthorized access, or misuse of confidential information.
